Privacy Notice

1.1 The purpose of this Privacy Notice (hereinafter referred to as the “Privacy Notice”) is to set out and describe the privacy and data protection policy of Landventure Limited Liability Company (registered office: 1037 Budapest, Fanyarka utca 1 B. lház. földszint 7., Hungary, company registration number 01-09-382197; tax number: 29176878-2-41; email: info@thelandventure.com; hereinafter referred to as the “Service Provider” or “Data Controller”). This Privacy Notice contains all relevant information regarding the details of the data processing activities carried out by the Service Provider.

1.2 The Data Controller's activities comply with the obligations set out in this Privacy Notice and the law. The Data Controller reserves the right to change this Privacy Notice by informing the data subjects in a timely and appropriate manner. If several different versions of the Privacy Notice are available, the last version uploaded to the Website shall apply. Accordingly, it is important that Data Subjects carefully review and study this Privacy Notice before providing their consent and/or personal data. The Data Controller shall pay particular attention to the confidentiality of personal data obtained in the course of the data processing activities described in this Privacy Notice, taking all security and technical measures necessary to ensure the security of personal data and their processing, while respecting the right to informational self-determination.

1.3 The Data Controller will process the personal data of data the subjects (hereinafter collectively referred to as “Data Subjects”) who subscribe to the Data Controller's newsletter, use the services of the Service Provider, whether on the website www.thelandventure.com (hereinafter referred to as “Website”) or otherwise, or whose personal data are processed by the Data Controller in connection with its other services.

1.4 This Privacy Notice covers all data processing activities performed by the Data Controller as listed above. The Data Controller reserves the right to change this Privacy Notice at any time.

1.5 The data processing activities performed by the Data Controller shall in all cases be compliant with the requirements set out in this Privacy Notice and the applicable laws.

Definitions
Personal data: any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
Data Processing: any operation or set of operations which is performed upon personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
Data Controller: a natural or legal entity, public authority, agency or any other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of the processing are determined by Union or Member State law, the controller or the specific criteria for the designation of the controller may also be determined by Union or Member State law;
Data Processor: a natural or legal person, public authority, agency or other body which processes personal data on behalf of the data controller.

The Scope of Data Processing

The Service Provider uses personal data that are necessary for the performance of the Services provided by the Service Provider. You do not need to provide any personal data to use the Website, however, at least your full name, address and e-mail address are required to make a purchase in order to issue a payment receipt in accordance with the applicable legal requirements.

The data may be accessed by all employees of the Service Provider in order to contact Users.

The Purpose of Data Processing
The data recorded about the User may be used to resolve issues and disputes between the User and the Service Provider. The purpose of data processing is to comply with legal requirements, to compile visitor statistics for internal purposes and to contact Users. The data provided during registration is processed by the Service Provider in order to identify the User and issue invoices.

The Data Controller shall carry out its data processing activities on the basis of and within the framework of the legal provisions in force at any given time, in particular the following legal provisions:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46/EC (the “General Data Protection Regulation” or “GDPR”)
  • Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information (“Privacy Act”)
  • Act V of 2013 on the Civil Code (“Civil Code”)
Certain Data Processing
a) Communication and Customer Service
Personal data shall be processed by the Data Controller for the purposes of maintaining contact with Users, handling complaints and providing customer service.

Retention of data: Five years, but up to the statutory limitation period.

b) Newsletters
Sending newsletters to subscribing users about products and news of the Service Provider.

Legal basis for processing: Consent by data subjects - Article 6 (1) a) of the GDPR
Retention of data: until opting out.

c) Compliance with legal obligations when purchasing, invoicing

Retention of data: for the period prescribed by law, but not less than 8 years.

The Rights of Data Subjects
Data subjects have the following rights with regard to data processing.
Data subjects have the right to:
  • receive confirmation that data relating to them is being processed, to receive information about the data processed, to receive further information about the processing and to request a copy of the data (Article 15 of the GDPR);
  • request that incorrect or incomplete data be corrected or completed (Article 16 of the GDPR);
  • request the immediate erasure of data relating to them (Article 17 of the GDPR), and to request the restriction of processing (if further processing is required based on Paragraph 3 of Article 17 of the GDPR);
  • receive data relating to and provided by them and to transmit such data to other service providers/responsible parties (Article 20 of the GDPR);
  • object to the processing activities of the Data Controller (Article 21 of the GDPR)
  • lodge a complaint with the supervisory authority if the data subject considers that data relating to him or her are being processed by the Data Controller in breach of data protection rules.

The Service Provider shall process the requests received by the Customer Service as soon as possible, but within 30 days at the latest, and shall notify the User of the response.

Legal Remedies
The Service Provider shall endeavour to settle any disputes that may arise in connection with the processing of data amicably. If the amicable settlement of disputes is unsuccessful, the User may turn to the National Authority for Data Protection and Freedom of Information (registered office: 1125 Budapest, Szilágyi Erzsébet fasor 22/C) (“Authority”), and may enforce any other claims in court.

Anonymous Visitor Identifiers
An anonymous visitor identifier (cookie) is a series of signals that can be used to uniquely identify a visitor or to store profile information, which is placed by the server on the computer of the visitor of the Website. Such a sequence of signals is not in itself capable of identifying the Website visitor in any way, but only of recognising the visitor's computer. You do not need to accept cookies to browse the Website, but the shopping function will not work if cookies are disabled in your browser.

Transfer of Data
The User acknowledges that the following personal data stored by the Data Controller in the user database of www.thelandventure.com will be transferred to OTP Mobil Kft. (1143 Budapest, Hungária körút 17-19.), as data processor. The scope of the data transmitted by the Data Controller is as follows: name, e-mail.
